Case Study – Scenario Planning for Potential Litigation Communications

A global parts supplier in the automotive industry was facing multiple government investigations, recalls, and potential litigation regarding the safety and functionality of its products. The announcement of an investigation by regulators into one of this supplier’s products then triggered global scrutiny from other regulators and government agencies, consumers, customers, employees, and the media. 

Our role

The company and outside counsel decided that the development of a litigation communications strategy was required and retained our team to deliver on their priority. 

We developed a communications response strategy under multiple hypothetical scenarios, including the outcome of government investigations, multidistrict litigation, inquiries from local, national and international media outlets, and internal communications to employees, board members and others. After the announcement of one government investigation, we executed a multi-stakeholder engagement strategy to respond appropriately, accurately and in line with the company’s legal strategy. The strategy included engaging the media to provide statements and background information, as well as employee, board and investor communications materials. 

Our Impact

Our strategy protected the reputation of the client in the face of daunting public scrutiny, positioning the company to preserve and enhance relationships with customers and regulators, while working on the ongoing investigations.  

Leveraging intelligence from related automotive supplier recalls and investigations, we were able to craft an informed strategy and approach to proactive and reactive stakeholder engagement.
