FTI Consulting advised a publicly-traded multinational, multi-billion dollar public company on a variety of reputation, litigation, and regulatory issues around one of its core products. The company faced increasing pressure from activists in the U.S. and Europe that had hijacked science and regulatory processes to attempt to ban the product due to their contention that it posed health concerns.
FTI Consulting developed a campaign to discredit junk science and promote scientific integrity and the importance of following the scientific process in evaluation of products. Immediate engagement of the media and briefings with influential politicians were initial steps, while development of an information platform in collaboration with a trade group followed. By leveraging Freedom of Information Act requests and the firm’s investigative capabilities, FTI Consulting was able to uncover and publicize the truth behind a broad campaign against the client, which included ongoing collaboration between elements at regulatory agencies, non-governmental organizations, known activists, and plaintiff attorneys. As litigation arose around the safety of the product, FTI Consulting also supported the legal strategy through intelligence gathering, positioning, and media engagement.
The ongoing campaign was successful in blunting activists in their attempt to ban the product by driving a more balanced political debate and media coverage, ultimately driving regulatory decisions that were based on sound science and not activist pressure.
